本隐私声明(以下简称”声明”)由 ERS Energy Sdn Bhd 代表其本身及其子公司和关联公司(以下统称”我方”或”我们”)向您发出。在本声明中,”个人资料”和”处理”具有 2010 年个人资料保护法(以下简称”该法令”)所规定的相同含义。
This privacy notice (“Notice”) is issued by ERS Energy Sdn Bhd and by ERS Energy Sdn Bhd on behalf of its subsidiaries and related corporations (collectively “our”, “us” or “we”) to you. For the purpose of this Notice, the terms “personal data”, and “processing” shall have the same meaning as prescribed in the Personal Data Protection Act 2010 (“Act”).
1. 本声明用于告知您:您的个人资料正由我们或代表我们处理,而您同意根据本声明对您的个人资料进行处理。
This Notice serves to inform you that your personal data is being processed by us or on our behalf and you agree to the processing of your personal data in accordance with this Notice.
2. 我们可能会不时向您收集各类个人资料,包括但不限于:姓名、出生日期、年龄、马来西亚身份证号码及/或任何身份证件复印件、护照号码或其他个人身份号码、国籍、种族、性别、电子邮件地址、地址、联络号码、婚姻状况、照片、闭路电视图像与录像、银行账户资料、紧急联络资料、您不时提交或提供给我们的其他个人资料,以及我们后续从您处再次收集的所有其他个人资料。
We may collect a variety of personal data from you from time to time including but not limited to name, date of birth, age, Malaysian Identification Card number and/or copies of any identification card, passport number or such other personal identification number, nationality, race, gender, e-mail address, address, contact number, marital status, photographs, CCTV images and footages, bank account details, emergency contact details, other personal data which is submitted or made available by you to us from time to time and all other personal data we again collect from you on any subsequent occasion.

allowing you access any online platforms or sites owned, operated or managed by us or on our behalf (“Platform”);
授予您进入任何相关场所/设施的权限,包括但不限于由我们或代表我们拥有、运营或管理的场所/设施(“我方场所”);
granting you access to any relevant premises/facilities, including without limitation the premises/facilities owned, operated or managed by us or on our behalf (“Our Premises”);
与您沟通、处理您的查询或投诉、解决任何问题/争议并执行我们的权利;
communicating with you, dealing with your inquiries or complaints, resolving any issues/disputes and enforcing our rights;
我方系统及我方场所的运行、管理、改进及/或维护;
the operation, management, enhancement and/or maintenance of our system and Our Premises;
您的系统及您的场所的运行、管理、改进及/或维护,包括缺陷修复工作;
the operation, management, enhancement and/or maintenance of your system and your premises, including defect rectification works;
组织、参与、管理及/或履行与我们或代表我们组织或赞助的活动、竞赛、比赛、计划及其他项目相关的职责(“活动”);
organising, participating in, managing and/or carrying out duties in connection with our events, contests, tournaments, competitions, programmes and other activities organised or sponsored by us or on our behalf (“Events”);
为您宣传并提供有关我方及关联公司、业务伙伴的产品及/或服务的信息(例如活动、优惠或促销),包括但不限于向您发送电子通讯、推广营销资料、节日/生日问候与信息、礼品及/或礼券;
advertising and providing you with information (such as Events, offers or promotions) relating to our and our related corporations’ and business partners’ products and/or services, including without limitation sending you e-newsletters, promotional marketing materials, seasonal/birthday greetings and messages, gifts and/or vouchers;
发布在您参与我们任何活动期间或在我方场所拍摄的您的照片或视频;
publishing photographs or video footages of you, which are captured during your participation in any of our Events, or at Our Premises;
在紧急情况下联系您的紧急联络人;
contacting your emergency contact person in case of an emergency;
预防或调查任何欺诈、违法或犯罪活动;
preventing or investigating any fraud, illegal or criminal activities;

complying with any legal or regulatory requirements and/or directions and instructions from any law enforcement officer or governmental and regulatory bodies, ministries, statutory boards or other similar authorities;
涉及我方的潜在或实际企业重组或公司交易,包括但不限于任何合资、合并、收购、重组及/或重新组织,以及取得、处置、出售、转让我方任何或全部业务、权利、义务、资产或股份;
contemplated or actual corporate restructuring or corporate transaction involving us including without limitation any joint venture, merger, acquisition, restructuring and/or reorganization and/or acquisition, disposition, sale, assignment and/or transfer of any or all portion of our business, rights, obligations, assets or stock;

our record-keeping in the ordinary course of our business;

via our Platform and/or the cookies;
来自您为任何用途向我们提交或提供的任何信息或文件;
from any information or document submitted or provided by you to us for any of the Purposes;
当您通过电话、电子邮件及/或平台等各种方式与我们联系时;
when you contact us through various methods such as telephone calls, emails and/or the Platform;
来自闭路电视;
from CCTV;
来自任何第三方(包括但不限于监管及执法机构和其他第三方来源);及/或
from any third parties (including without limitation regulatory and law enforcement authorities and other third party sources); and/or
来自您与我们之间的所有其他通讯,以及您不时向我们提供的所有其他信息。
from all other communications between you and us and all other information that you may provide to us from time to time.
5. 您有权要求访问及更正您的个人资料,惟须遵守以下条件及该法令的规定:
You have the right to request access to and to request correction of your personal data subject to the following and subject to provisions of the Act:
您可向我们书面提出资料访问请求或资料更正请求;及
you may make a data access request or a data correction request in writing to us; and
我们可拒绝您的资料访问请求或资料更正请求,并须以书面通知向您说明拒绝及其理由。
we may refuse to comply with your data access request or a data correction request and shall, by notice in writing, inform you of our refusal and the reasons of our refusal.
6. 您可通过书面通知:(a) 限制我们处理您的个人资料,或要求我们停止或不开始处理您的个人资料;及/或 (b) 撤回您先前给予我们的同意(全部或部分),以处理您的个人资料,惟须遵守任何适用的法律限制以及合理期限以使撤回同意得以生效。如您限制处理或撤回同意使用您的任何或所有个人资料,可能导致:(i) 我们无法继续管理您与我们之间的任何安排或合同关系;(ii) 我们无法(继续)履行对您的任何合同义务(若有);(iii) 我们无法为任何用途处理您的个人资料;及/或 (iv) 终止您与我们之间的任何安排/协议/合同,我方无须承担任何责任(“后果”)。
You may, by sending a written notice: (a) limit the processing of your personal data or request us to cease or not begin processing your personal data; and/or (b) withdraw your consent previously given to us (in full or in part) to the processing of your personal data, subject to any applicable legal restrictions and a reasonable duration of time for the withdrawal of consent to be effected. If you limit the processing or withdraw your consent to any or all use of your personal data, it may result in: (i) us being unable to continue to administer any arrangement or contractual relationship in place between you and us; (ii) us being unable to (continue to) perform any of our contractual obligations to you (if any); (iii) us being unable to process your personal data for any of the Purposes; and/or (iv) the termination of any arrangements/agreements/contracts between you and us, without any liability on our part (“Consequences”).

our financial and other professional advisors including but not limited to auditors, accountants and lawyers (on a need-to-know basis);

9. 若处理您的个人资料以达成上述用途需要其他人的个人资料,我们可能需要您的协助。您兹此同意在需要时尽力配合协助。
We may require your assistance if the personal data relating to other persons is required to process your personal data for the Purposes and you hereby agree to use your best endeavors to assist us when required.
10. 若您向我们提供任何第三方的个人资料,您应在向我们提供该第三方个人资料之前确保该第三方已阅读本声明并同意我们就任何用途收集其个人资料。
In the event that personal data of any third party is supplied by you to us, you shall ensure that such third party has read this Notice and consented to us collecting his/her personal data for any of the Purposes prior to the supply of his/her personal data to us.
11. 若由他人向我们提供/提交您的任何个人资料,您同意您已授权该等披露,并同意我们根据本声明处理您的个人资料。
Where another person is providing/submitting any of your personal data to us, you agree that you have authorised the disclosure of your personal data to us and consented to the processing of your personal data by us in accordance with this Notice.
12. 您必须向我们提供我方表格中标明或指定为必填的个人资料。如您未能向我们提供任何此等个人资料,可能导致上文第 6 段所述的任何”后果”。
It is obligatory that you supply us the personal data marked or specified as compulsory in our forms. If you fail to supply us with any of the said personal data, it may result in any of the Consequences (as specified in paragraph 6 above).
13. 必要时我们可能将您的个人资料转移至马来西亚境外的地点,您兹此同意此转移。
We may, where necessary, transfer your personal data to a place outside of Malaysia and you hereby consent to the transfer.
14. 您有责任确保提供给我们的资料准确、完整、不具误导性并保持最新。
You are responsible for ensuring that the information you provide to us is accurate, complete, not misleading and kept up to date.
15. 我们可能不时更新及修订本声明。我们将通过我方平台、电子邮件或其他适当方式向您通知任何修订。任何修订自该等通知发出后生效。在修订通知发布后,如您继续与我们往来或访问我方平台,即视为已同意经修订及更新的本声明。
We may update and amend this Notice from time to time. We will notify you of any amendments to this Notice via notices on our Platform, through email or other appropriate means. Any such amendments will be effective upon such notification. By continuing to engage with us or accessing our Platform after the issuance of such amendment notice, you will be considered as having agreed to this Notice (as amended and updated).
16. 本声明的英文版本与中文版本如有任何不一致,以英文版本为准。
In the event of any inconsistency between the English version and the Chinese version of this Notice, the English version shall prevail over the Chinese version.
