These Terms of Use (“Terms”) govern your access to and use of this website and any related online services (collectively, the “Site”) provided by ERS Energy Sdn Bhd and its subsidiaries and related corporations (collectively “ERS”, “our”, “us”, or “we”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, please do not use the Site.

The Site offers various calculators (including without limitation solar sizing, residential and commercial ROI, financing, BESS, investment returns, tax incentive, and carbon impact calculators) and other interactive tools. All outputs from these calculators are illustrative estimates only, generated from generalised assumptions and rounded inputs. They do not constitute a quotation, contract, financial advice, engineering certification, or guarantee of performance.

Actual project costs, generation, savings, payback periods, IRR, NPV, and other figures depend on site-specific factors that require a professional assessment. Submitting a contact form, requesting a free quote, or generating any calculator output does not by itself form a binding agreement between you and ERS. A binding agreement is formed only upon execution of a written contract or purchase order signed by an authorised representative of ERS.

All content on the Site, including without limitation text, graphics, logos, icons, images, audio clips, video clips, calculator formulas, and software, is owned by or licensed to ERS and is protected by Malaysian and international copyright, trademark, and other intellectual property laws. The “ERS Energy” name and logo are trademarks of ERS Energy Sdn Bhd.

Information may be updated or changed without notice. Tariff rates, government incentives, regulatory programmes (including without limitation Solar ATAP (in operation from 1 January 2026), the legacy NEM 3.0 scheme (closed to new applications on 30 June 2025), SelCo (which continues), GITA (60% on solar and 100% on BESS, administered by MGTC), and LSS), and other figures referenced on the Site are subject to change by the relevant authorities at any time. You should verify any specific figure with us or the relevant authority before relying on it for a financial or operational decision.

Our total aggregate liability for any direct claims arising from your use of the Site shall not exceed RM 100. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; the limitations above apply to the maximum extent permitted by applicable law.

In the event of any inconsistency between the English version and the Bahasa Malaysia or Chinese versions of these Terms, the English version shall prevail.
